Enforcement and Bankruptcy LawSale of Foreclosed Goods and Home Foreclosure

The first and most feared thing that comes to mind when it comes to foreclosure is the seizure of household items. If debtors do not pay their debts, forced enforcement is resorted to. While the enforcement proceedings are in progress, it is usual to come to the person’s home and seizure here. In this sense, the answer to the question “Can an execution come to my house?” is yes. However, the arrival of the officials at home does not mean that they can seize everything in the house. It is forbidden to seize the goods necessary for people’s lives. These goods can be counted as follows:

  • Refrigerator
  • Washing machines and dishwashers
  • Television
  • Iron
  • Sofa set
  • Bed
  • Carpet

However, if there is more than one of these goods in the house, those that are not needed can be seized. In addition, money, jewellery, antiques and precious stones are among the goods that can be seized at home.

The seized goods do not pass directly to the creditors. In order to settle the debt, these goods must be sold and the money must be given to the creditors. Accordingly, a request for sale must be made within 6 months from the date of seizure of movable goods and within 1 year for the seizure of real estate. If the creditor does not request a sale, the debtor may also request a sale. After the sale request, the valuation, announcement and tender stages follow. The sale of foreclosed goods is carried out by tender procedure, more commonly known as auction procedure. The money obtained after the sale is distributed to the creditors according to the regulations in the law and the enforcement and seizure works are terminated.

It is aimed that the auctions, which are currently carried out partly electronically and partly physically, will be fully electronic with the amendments to the new Enforcement and Bankruptcy Law.
