Labour law is a discipline of law that examines the issues of work, employee and employer; regulates the legal relations between the employee and the employer and seeks solutions to disputes. In addition, labour law regulates the relations of employers and employees with the state.
Labour law is divided into two sub-disciplines: individual labour law and collective labour law.
What is Individual Labour Law?
Individual labour law examines the legal transactions between the employer and the state and the employee as an individual. The establishment of the contract, the debts of the employee and the employer, the termination of the contract, working wages and periods, permits and occupational health and safety issues are discussed. Individual labour law is generally applied in small enterprises with a small number of workers and in workplaces where there are no union activities.
What is Collective Labour Law?
Collective labour law is the branch of law that deals with the legal relations entered into by employees or employers through the unions they have established. This field is divided into sub-branches as collective labour contract law, trade union law and collective labour disputes law.
Within the scope of trade union law, the principles of the establishment and functioning of trade unions, trade union rights and freedoms and trade union membership issues are examined.
In collective labour contract law, the conclusion of a collective labour contract between the employer or employer’s union and the employee union, the provisions and consequences of this contract are examined.
In the law of collective labour disputes, the peaceful settlement methods to be used in case collective labour negotiations result in a dispute and issues such as strikes and lock-outs are examined.
