Institutions in Charge of Combating Cybercrimes and Legal Framework
Cybercrime has become a major problem today with increasing digitalisation. These offences include attacks on information systems, data theft, cyberbullying and more. The institutions and legal framework in charge of combating cybercrime in Turkey are important to protect citizens’ rights and prevent crimes.
1. Information and Communication Technologies Authority (ICTA): ICTA is an organisation that regulates and enforces the IT field in Turkey. The ICTA’s duties include combating cybercrimes, establishing and implementing cybersecurity policies. Furthermore, ICTA carries out inspections of internet service providers and informs citizens about cybercrimes.
2. Directorate General of Security, Department of Combating Cyber Crimes: Operating under the General Directorate of Security, this unit plays an important role in the fight against cybercrimes. The Department of Combating Cybercrimes investigates cybercrimes, identifies criminals and refers them to the judiciary. It also organises cyber security trainings and raises awareness among citizens.
3. Ministry of Justice IT Department: The IT Department of the Ministry of Justice manages the judicial processes related to cybercrimes. This department carries out evidence collection, examination and reporting in cases filed against cybercrimes. It also co-operates with the courts and supports the judicial processes.
4. Turkish Penal Code (TPC) and Related Legislation: Turkish Penal Code No. 5237 contains provisions on cybercrimes. This law regulates breaking into the information system, data breach, slander, defamation and other offences. In addition, the Personal Data Protection Law No. 6698 on the protection of personal data is also an important regulation on cybercrimes.
5. International Co-operation: Since cybercrimes transcend borders, international co-operation is important. Turkey plays an active role in the fight against cybercrime by cooperating with INTERPOL and other international organisations.
