Information Technology LawWhat is Information Technology Law?

Information Technology Law is a branch of law that deals with the sharing of digital information. Internet law, which determines the legal framework for the use of the Internet, is also an important part of information law. In this field, concepts such as privacy, freedom of expression and digital rights play a central role.

Information technology law, which is divided into two under the titles ofInformation Technology Law and Internet Law, deals with different aspects:

  1. Information Technology Law: This area regulates the distribution of digitised information and computer programmes. It includes issues such as ensuring information security, electronic commerce regulations and licensing.
  2. Internet Law: Analyses the legal issues arising from the use of the Internet. It interacts with areas such as Internet access, use, security, freedom of expression and judgement.

Information law is gaining more and more importance today. Some of the frequently encountered issues in this field are as follows:

  • Data Security and Privacy: Issues such as the protection of personal data, reporting data breaches and data transfer are included under this heading.
  • Copyright and Intellectual Property: Copyright violations on the Internet and protection of intellectual property rights are important.
  • Information Crimes: Crimes such as unauthorised access to computer systems, computer sabotage, fraud and forgery are examined in this area.
  • Electronic Commerce and Consumer Rights: Regulation of trade on the Internet and protection of consumer rights are important.

In Turkey, IT law is regulated by the Law No. 5651 on the Regulation of Publications on the Internet and Combating Crimes Committed Through These Publications. In addition, Articles 243 to 246 of the Turkish Criminal Code determine the offences committed in the field of informatics and the criminal sanctions to be applied to these offences.

Informatics law is becoming more important in today’s world where technology is developing rapidly. Experts working in this field play a major role in protecting the rights of Internet users and ensuring a fair environment in the digital world.
