The residence status of foreign spouses in Turkey after divorce has important consequences for both family law and immigration law. The family residence permit obtained due to marriage may lose its legal basis upon divorce. Therefore, a new status should be determined after divorce.

After divorce, the family residence permit may expire or is at risk of expiring. However, this situation is not always automatic and instantaneous. The duration of the marriage, the presence of children, the death of the spouse or special cases of victimisation are assessed separately.
