The first and most important step for foreigners wishing to acquire real estate in Turkey is the title deed process. Although title deed transactions are often perceived as only the sales contract and payment process, this process is much more comprehensive for foreigners. Because both the legal status of the immovable property and the buyer’s right of acquisition should be evaluated separately.

Firstly, it should be checked whether the immovable property to be purchased is suitable for foreigners. Not every immovable property may be suitable for every foreigner. The region where the immovable property is located, its nature and whether there are any restrictions on it should be examined. In particular, military prohibited zones, special security areas and similar restrictions may directly affect title deed transactions.

The second stage is the detailed examination of the land registry. If there is a mortgage, lien, annotation, usufruct right or any other restriction on the immovable property, this affects the purchase decision. The most common mistake made by foreign buyers is to focus only on the physical appearance of the property. However, legal records are more decisive than physical features.

The third important issue is the official documentation of the sale price and the payment process. Especially for purchases made for citizenship purposes, the payment must be made through the banking system, the receipts must be kept, and there must be a correspondence between the title deed and the payment. Hand payments or undocumented transfers pose a serious risk.

The fourth stage is the complete preparation of the necessary documents. Passport, tax number, photograph, translations, power of attorney and other official documents must be completed before the transaction. Even a deficiency in the documents may cause the transaction to be prolonged.

During the transaction at the land registry office, the contract and declarations should be carefully examined. One of the biggest risks of foreign buyers is that they sign the contract without fully understanding it. Therefore, the contract language, terms of sale, delivery date and payment schedule should be clear.

Finally, it is recommended to get legal counselling from the beginning of the process. Because title deed transactions mean not only buying and selling, but also the safe transfer of ownership. If proper planning is not done, problems that are difficult to compensate may arise later.
